Unmittelbar vor Ende des Vorgängerforums hatte ich eine Sammlung von Nachrichten zum geplanten Mpenjati Beach an der südafrikanischen Ostküste zusammengestellt. Zum Verfolgen der aktuellen Entwicklungen ist es leichter wenn man in einem Thread nicht zwischen zwei Foren hin- und herspringen muß, deshalb hier zuerst eine Kopie der bereits gelieferten Informationen, dann kommt Neues darüber, was sich in den letzten Tagen über Ostern dort getan hat:

Hier gibt es eine bessere Quelle [als http://www.travelbook.de/welt/FKK-in-Su ... 83176.html ] für die Benimmregeln für den 20141028 von der Gemeinde genehmigten, aber noch nicht durch z.B. Aufstellen von Schildern eingerichteten offiziellen Strand Mpenjati Beach. Laut bisheriger Planung soll er liegen NE der Lagune, in der der Mpenjati-Fluß endet. Das wäre nach meiner groben Schätzung bei ca. S30.970, E30.288 :

Even though the nudist beach planned for Trafalgar has not yet been officially opened, those who wish to use the demarcated area (as a nudist friendly beach) will not be prosecuted during the festive season. Hibiscus Coast Municipality spokesman, Simon Soboyisa-April, said that the by-laws had been relaxed since council has approved the beach. However, the KwaZulu-Natal Naturist Association has set up a code of conduct for the nude beach, which is expected to be officially open by next Easter.

Die Zustimmung im Gemeinderat erfolgte trotz der verbreiteten Ablehnung in der örtlichen Bevölkerung mit erstaunlicher Mehrheit:

More than 30 Hibiscus Coast Municipality councillors voted in favour of the proposed nudist beach at a council meeting held at the chambers today. Eight councillors voted against it, while five abstained.

Interessant ist die Begründung der Gemeinde, daß aufgrund der Verfassung eine Diskriminierung von Bevölkerungsgruppen unzulässig ist und auch deshalb (außer des Hauptarguments der Hoffnung auf Einkünfte durch Besucher) der Strand genehmigt wurde:

The municipality's Simon Soboyisa says the application tested the resoluteness of the municipality in practicing the spirit of the constitution, which provides that state may not unfairly discriminate against directly or indirectly on anyone on one or more grounds.

Ein Jahr könne das aber noch dauern bis die Infrastruktur fertig wäre:

Es gibt aber das rechtliche Problem, daß ein Gemeinderat zwar vor sich hin beschließen kann was er will, aber Umweltrecht ist übergeordnet, und dort gibt es anscheinend eine Kollision mit dem Schutzgebiet "Trafalgar Marine Protected Area". Noch unausgegoren ist anscheinend die Lage des geplanten Strandes, statt Koordinaten gibt es offenkundig mal wieder traditionell diffuses Herumgelaber. Auch würde Umwelterziehung beeinträchtigt durch Vergraulen der Öffentlichkeit:

The Trafalgar Marine Protected area, a 4.6km stretch of shoreline, is situated in this area, between Mpenjati Nature Reserve and San Lameer, with about a third of it adjoining the reserve. Mr Norman [chairman of the South Coast branch of the Wildlife and Environmental Society of South Africa (Wessa)] had not been able to ascertain the exact co-ordinates for where the nudist beach would be situated. ... “The point of Marine Protected Areas is, firstly, to conserve the marine environment but also to educate the public about marine environmental issues. Turning a section of a Marine Protected Area into a nudist beach is counter-productive to its educational function, particularly with regards to educational programmes for children,” he added.

Rechtlich spannend kann es auch noch werden, wenn es dazu kommt, daß vor Gericht die Meinung des "gesunden Volksempfindens" gegen die Verfassung antritt, und noch unerfreulicher wäre, wenn die Polizei den Nackten gegebenenfalls Zugang zum Strand verschaffen müßte gegen absperrende Streikposten:

The 500m nude beach will be between Trafalgar and Palm Beaches ... The application by the KZN Naturists Association to have the beach declared nudist friendly was vehemently opposed by religious and cultural groups on the grounds of morality. They said granting a licence to a nude beach would increase prostitution and crime in the area. ... But opponents of the beach said they will not take the decision lying down. A coalition of religious and cultural groups and moralists was considering challenging the municipality’s decision in court. Bhekani Khumalo said the local communities who live near Mpenjati Beach will picket against nude bathers. "We will fully support a court application against the nude beach. If we allow such a thing to happen in our midst we would be sending the wrong signal to our children and the whole society that having people swimming in the nude is correct thing to do. This would be allowing all sorts of lawlessness," he said.

Erwähnt sei, daß der Verband der südafrikanischen Nackten Einrichtung dieses Strandes begrüßt, es steht also nicht nur eine kleine örtliche Gruppe von Strandbesuchern hinter diesem Projekt:

Athol Lutge, chairman of the SA National Naturist Association, which presented the application to the municipality and of which the newly formed KZN Naturist Association is part, said he was pleased and “very surprised”. “We thought we had a 50/50 chance of it being approved. But being a practical guy, when they announced their decision, my head started already spinning with all the work and planning that now needs to be done in terms of the coastal access application. “I don’t know how long it will take, but I am hoping it will be done before World Naturists Day, which is on December 14.

Nun zu den Entwicklungen über Ostern als Karfreitag eine Konfrontation mit der Polizei gerade noch abgewendet werden konnte. Der Strand wurde danach am Osterwochenende inoffiziell von Benutzern eingeweiht. Die Bürgerinitiative "Concerned Citizens Group" wollte die Nackten von der Polizei verhaften lassen, da das den Nacktstrand erlaubt habende Gemeinderecht nicht über dem Landesrecht stehen dürfe. Das ist eine interessante Spiegelbildsymmetrie zu meinem früher geäußerten Ausdruck, daß Dorfrecht Landesrecht brechen darf wenn das Dorfrecht, wie so häufig, gegen Nackte eingesetzt wird. So kennt man es aus England, Dtl. mit seinen vom Gemeinderat ausgebrüteten Polizeiverordnungen, Spanien wo der FEN versucht sich dagegen zu wehren, und schließlich dem in dieser Hinsicht weltberühmten Appenzell.

Das Landesrecht besagt:

No person shall be on the seashore or in the sea or any other place to which these bylaws apply, other than a booth, toilet or change room, unless so dressed that, if a female, her nipples are concealed from view and, if a male or female, [their] private parts are concealed from view, and in each case by a suitable article of opaque clothing.

Die Gemeinde wollte ursprünglich zu Ostern den Strand offiziell eröffnen, hat das aber verschoben aufgrund der Proteste, will aber nicht gegen inoffizielle Einweiher vorgehen:

Da sage mal jemand, daß einfache Nacktheit nicht in der Lage wäre die "Öffentliche Ordnung" zu stören, wenn sogar ein Pfarrer, der von der "Concerned Citizens Group", eine Pfarrerin von der Polizei festnehmen lassen wollte, und dabei zittert die schon so vor ihrer Kirche, daß sie ihren Besuch dort geheim halten muß.

Für heute, 20150407, hat die Bürgerinitiative ein Treffen anberaumt bei dem sie überlegen wollen, den "Public Protector" einzuschalten, der als Ombudsman staatliches Fehlverhalten überprüfen darf:

Das Thema "Mpenjati Beach" hätte fast noch besser in den Thread "FKK & Recht" gepaßt. Es ist spannend, wie dieses rechtliche Fingerhakeln ausgeht bei der Frage, ob eine Gemeinde eine nacktfreundliche Regelung auf ihrem Gebiet durchsetzen kann, die mit dem dortigen Landesrecht vielleicht im Gegensatz steht. Die Sache eskaliert, der "Public Protector" wurde jetzt wie angekündigt tatsächlich eingeschaltet wie heute berichtet wird:

Die kolonialen Panikanfälle beim Gedanken an unbekleidete Wilde haben anscheinend dort einen tiefen Graben gebuddelt zwischen Religionsvertretern und Nackten:

Das hört sich unerfreulich an, daß dort vielleicht Todesstrafe für Nackte droht, vollstreckt vom "gesunden Volksempfinden", und schlimmer noch, daß nicht einmal die Pfarrer für die Nackten beten wollen.

Mich würde es wundern und gleichzeitig freuen, wenn in Südafrika ein offizieller Nacktbadeabschnitt eröffnet würde, aus vielen Gründen. Wie auch immer, mir ist es öfter gelungen, dort mit Gleichbe- und gesonnenen hüllenlos am Strand rumzuhängen, ohne Probleme. Möglicherweise lag es daran, dass es Riesenstrandabschnitte ohne nennenswerte Laufkundschaft sind und es eben nicht offiziell oder bekannt ist - und damit in keinem Fadenkreuz einer Opposition auftaucht.
Europäische Maßstäbe allerdings werden beim Umgang mit dem Thema genauso versagen wie bei einem Großteil anderer Themen im südlichen Afrika.

Kam mir doch irgendwie bekannt vor: wir waren letztes Jahr nicht weit davon in Leisure Bay mehrmals im Ressort 'T.O. Strand' - zwar etwas mitgenommen, aber sehr günstig - falls jemand eine Unterkunft in der Nähe sucht
